DIVISION OF REVENUE BILL: FINAL MANDATES

SUMMARY
Six final mandates on the Division of Revenue Bill were available and were presented. Only the Limpopo province recommended some changes to the Bill. The Division of Revenue Bill was accepted unanimously.  The Northern Cape and North West did not submit mandates. The Western Cape provided a verbal mandate as it did not have one in writing.

MINUTES
The provinces presented their final mandates:

Mpumalanga
The Chairperson went through the final mandate for Mpumalanga as the representative for the province was not present at the meeting. No amendments had been made to the final mandate on the Division of Revenue Bill.

Gauteng
The Chairperson went through the final mandate for Gauteng as the representative for the province was not present in the meeting. The province approved the Division of Revenue Bill.

Limpopo
Mr D Botha (ANC, Limpopo) went through the final mandate for Limpopo. The province had made some recommendations but mandated approval of the Division of Revenue Bill.

Free State
The Chairperson went through the province’s final mandate in the absence of a Free State delegate. It approved the Division of Revenue Bill.

Eastern Cape
The Chairperson went through the province’s final mandate as the Eastern Cape delegate had not yet arrived. The province approved the Division of Revenue Bill.

Kwazulu-Natal
Ms Ntwanambi (ANC, Western Cape) read out the Kwazulu-Natal final mandate. The province approved the Division of Revenue Bill.

Western Cape
Ms Robinson (DA, Western Cape) gave the members a verbal mandate as the province’s mandate was not in writing. She said that the province approved the Division of Revenue Bill.


After the mandates had been read out, the Chairperson asked the State Law Advisor if the Committee would be able to pass the Division of Revenue Bill, without having the six provincial representatives present. The State Law Advisor said that he did not know what the parliamentary rule on this was, but his understanding was that a quorum was needed in order for the Bill to be passed. The State Law Advisor went to consult with the legal advisors attached to Parliament.

Mr O Robertson (ANC, Eastern Cape) then arrived which meant that the Committee had a five-member quorum and the Bill could be passed.

Voting on Bill
Mr Robertson moved for the Bill to be passed by the Committee. Ms Robinson (DA, Western Cape) seconded the move. The Bill was unanimously approved by the Committee.
