The Committee had a brief virtual meeting to consider the final provincial mandates on the Fundraising Amendment Bill [B29B - 2020].
All nine provinces voted in favour of the Bill. The Committee also adopted the accompanying report on the Bill.

Opening remarks
The Chairperson welcomed everyone in attendance. He said that the agenda was to go through the final mandates on the Fundraising Amendment Bill, and for the Committee to consider and adopt its Report on the Bill. He asked if there were any apologies.

The Committee Secretary, Ms Marcelle Williams, said that she received apologies from Ms E Nkosi (ANC, Mpumalanga), Ms N Ndongeni (ANC, Eastern Cape) and Mr I Ntsube (ANC, Free State). They were all travelling abroad to attend a Whippery Conference in Germany.

She noted that Ms A Maleka (ANC, Mpumalanga) was appointed as an Alternate Member for Mpumalanga, and Ms Lydia Moshodi (ANC, Free State) would represent the Free State.

Fund-Raising Amendment Bill: Provincial Final Mandates
Eastern Cape
Mr Z Mkiva (ANC, Eastern Cape) said that the mandate of the Eastern Cape had been signed by Ms Helen Sauls-August, Speaker of the Eastern Cape Provincial Legislature. The Eastern Cape province voted in favour of the Bill.

Free State
Ms Moshodi said that the mandate of the Free State had been signed by Ms Ntombizanele Sifuba, Speaker of the Free State Provincial Legislature, on 19 September 2023. The Free State Legislature voted in favour of the Bill.

KwaZulu-Natal (KZN)
Ms G Swartbooi-Ntombela (ANC, KZN) said that the KZN Legislature met on Thursday, 21 September 2023, and agreed to mandate the KZN delegation to the National Council of Provinces (NCOP) to support the Bill.

Gauteng
Mr E Nchabeleng (ANC, Ms S Lehihi (EFF, Limpopo) said that the Gauteng Legislature supported the principle and the detail of the Bill. It therefore voted in favour of the Bill. The mandate was signed by Ms Ntombi Mekgwe, Speaker of the Gauteng Provincial Legislature.

Limpopo
Mr Nchabeleng said that the Limpopo Legislature mandated its delegate in the NCOP to vote in favour of the Bill. The mandate was signed by Ms Reneiloe Rosemary Molapo, Speaker of the Limpopo Provincial Legislature.

Mpumalanga
Ms Maleka said that the delegation that represented Mpumalanga in the NCOP voted in favour of the Bill. The mandate was signed by Ms Makhosazane Masilela, Speaker of the Mpumalanga Provincial Legislature.

Northern Cape
Ms D Christians (DA, Northern Cape) said that in terms of Section 65 of the Constitution, the Portfolio Committee on Health and Social Development (Northern Cape) recommended that the House confer authority on the head of its delegation to the NCOP to vote in support of the Bill. The mandate was signed by Ms Newrene Klaaste, Speaker of the Northern Cape Provincial Legislature, as well as the Chairperson of the Portfolio Committee on Health and Social Development (Northern Cape), Ms S Tities.

North West
A Member representing the North West said that the North West Legislature voted in favour of the Bill. The mandate was signed by Ms Sussana Dantjie (ANC), Speaker of the North West Provincial Legislature.

Western Cape
The Chairperson said that having considered the subject of the Bill, the Western Cape delegation in the NCOP supported the Bill. The mandate was signed by Mr Daylin Mitchell, Speaker of the Western Cape Provincial Legislature.

Adoption of Report on the Fund-Raising Amendment Bill
The Chairperson said that the Bill was referred to the Committee on 28 September 2022. The Department of Social Development briefed the Committee on 16 May 2023. All provinces had briefings and public hearings on the Bill between 24 May and 25 August 2023. All provinces concluded their public hearings by 25 August 2023. All provinces submitted their negotiating mandates on 5 September 2023. The Committee finalised the Bill on 22 September 2023 and adopted it without amendments.

The Committee considered its Report on the Bill, dated 22 September 2023.

Mr Nchabeleng moved for the adoption of the Report; Mr Mkiva seconded this.

Closing remarks
The Chairperson invited the Parliamentary Legal Adviser to comment.

Mr Nathi Mjenxane, Parliamentary Legal Adviser, said that the process followed by the Committee was in line with the National Assembly Rules. He had no further comments.
