Meeting Summary

In a virtual meeting, the Select Committee convened to consider its reports on the Prescription in Civil and Criminal Matters (Sexual Offences) Amendment Bill [B22B-2019] and on the provisional suspension from office of Ms K Bodlani, an Acting Regional Magistrate at Umlazi, KwaZulu-Natal, in terms of section 13(3)(b) of the Magistrates Act.

Both Committee Reports were adopted.

Meeting report

The Select Committee convened to consider its Report on the Prescription in Civil and Criminal Matters (Sexual Offences) Amendment Bill [B22B-2019] and on the provisional suspension from office of Ms K Bodlani, an Acting Regional Magistrate at Umlazi, KwaZulu-Natal, in terms of section 13(3)(b) of the Magistrates Act.

Committee Report on the Prescription in Civil and Criminal Matters (Sexual Offences) Amendment Bill [B 22B - 2019] (s75)

The Chairperson recapped salient features of the Bill and said the Committee had received a further briefing on 26 August on the written submissions on the Bill and  had been satisfied with the Department’s responses to the submissions and  agreed to the adoption of the Bill.

The Committee Report on the Bill was considered and adopted. 

The Chairperson said she hoped the Bill would go a long way and give hope and encourage sexual survivors to come forward as crimes could be prosecuted irrespective of when the offence occurred.

Report of the Select Committee on Security and Justice on the provisional suspension from office of Magistrate K Bodlani, Acting Regional Magistrate, Umlazi

The Chairperson said the Committee Report confirmed the provisional suspension of Ms Bodlani.

Mr T Dodovu (ANC, North West) requested that the Chairperson go through the Report’s recommendations.

The Chairperson recognised Mr Dodovu’s concerns that were expressed in the previous meeting and said that that was reflected in the minutes of the meeting.

The Report was adopted.

Consideration and adoption of Committee Minutes

The minutes of the meeting held on 26 August 2020 was considered and adopted.
