Meeting Summary

Provinces presented their final mandates on the National Credit Amendment Bill. No final mandate was received from KwaZulu-Natal. With the exception of the Western Cape Province, which did not support the Bill, the remaining seven provinces voted in favour of it.

The Committee Report on the Bill reflected that the Committee agreed to the Bill without amendments.

Meeting report

The Chairperson stated that Parliament’s Constitutional and Legal Services Office (CLSO) had, in a previous meeting, presented its response to the negotiating mandates submitted in respect of the National Credit Amendment Bill. 
 
The Committee would deal with the final mandates in today’s meeting.
 
Final Mandates on the National Credit Amendment Bill
Eastern Cape Province
Mr M Rayi (ANC, Eastern Cape) stated that the Eastern Cape Provincial Legislature had voted in favour of the Bill.
 
Free State Province
In the absence of a delegate from the Free State Provincial Legislature, Mr Rayi read out the final mandate. The Free State Provincial Legislature had voted in favour of the Bill.
 
Gauteng Province
Ms M Dikgale (ANC, Limpopo) stated that the Gauteng Provincial Legislature had voted in favour of the Bill.
 
KwaZulu-Natal Province
The KwaZulu-Natal Provincial Legislature had not submitted a final mandate.
 
Limpopo Province
Ms Dikgale said that the Limpopo Provincial Legislature had voted in favour of the Bill.
 
Mpumalanga Province
In the absence of a delegate from the Mpumalanga Provincial Legislature, Mr O Terblanche (DA, Western Cape) read out the final mandate. The Mpumalanga Provincial Legislature had voted in favour of the Bill.
 
North West Province
Mr B Nthebe (ANC, North West) stated that the North West Provincial Legislature had voted in favour of the Bill.
 
Northern Cape Province
In the absence of a delegate from the Northern Cape Provincial Legislature Mr L Magwebu (DA, Eastern Cape) stated that the Provincial Legislature had voted in favour of the Bill.
 
Western Cape Province
Mr Terblanche said that the Western Cape Provincial Legislature had not supported the Bill. He wished for the Committee’s record to reflect that the DA did not support the Bill.
 
Committee Report on the Bill
The Chairperson proceeded to read out the Report of the Committee on the Bill which essentially stated that the Committee agreed to the Bill without amendments.
 
The Chairperson pointed out that on the Copyright Amendment Bill and the Performers Protection Amendment Bill, the closing date for submissions had been on Friday 22 February 2019. He noted that the Committee Researcher, Mr Abdullah Ganief duly assisted by other staff members had compiled a summary document of the huge amount of submissions received on the Copyright Amendment and the Performers Protection Amendment Bills. The Committee would meet the following week, Wednesday 6 March 2019 to get responses from the DTI on the submissions made.
