The‌ ‌Committee‌ ‌considered‌ ‌and‌ ‌accepted‌ ‌minor‌ ‌changes‌ ‌to‌ ‌the‌ ‌A-list‌ ‌of‌ ‌changes‌ ‌to‌ ‌the‌ ‌Civil‌ ‌Aviation‌ ‌Amendment‌ ‌Bill.‌ ‌The‌ ‌Committee‌ ‌considered‌ ‌and‌ ‌adopted‌ ‌each‌ ‌individual‌ ‌clause‌ ‌as‌ ‌introduced‌ ‌or‌ ‌as‌ ‌amended.‌ ‌The‌ ‌Committee‌ ‌adopted‌ ‌its‌ ‌report‌ ‌on‌ ‌the‌ ‌Bill.‌

The Chairperson accepted an apology from Ms N Nolutshungu (EFF).

Consideration of the A-list of changes to the Civil Aviation Amendment Bill

Adv Frank Jenkins, Senior Parliamentary Legal Advisor, explained that there had been a few minor changes to the A-list since it had last been considered. Notably, Clause 60 clarified that the Civil Aviation Authority (CAA) must take legal action against parties that failed to transmit fees collected on its behalf, and a sentence to the effect that the CAA would be the preferential creditor with respect to these fees had been inserted into the long title of the Bill. 

Mr C Hunsinger (DA) asked what the final outcome of the discussion of the role and status of the Civil Aviation Regulations Committee (CARCom) had been. 

Mr Levers Mabaso, Acting Chief Director: Aviation Safety, Security, Environment and Search and Rescue, Department of Transport, explained that the establishment of CARCom had been removed from the body of the Act and would henceforth be established through regulations. 

Mr L Mangcu (ANC) asked for clarification of the significance of the change to the long title of the Bill.

Adv Jenkins explained that the long title was a kind of summary of the most important contents of the Bill. It was useful while the Bill was being processed. However, the long title of the Bill did not become part of the Act once it was passed.

Mr Hunsinger moved to accept the changes.

Mr Mangcu seconded the motion.

The A List was adopted. 

Clause-by-clause consideration of the Civil Aviation Amendment Bill

The Chairperson obtained agreement from the Committee on each individual clause as introduced or as amended.

Mr Mabaso drew attention to a minor grammatical inconsistency in Clause 49. 

Mr Hunsinger moved for adoption of the Bill.

Mr L McDonald (ANC) seconded the motion.

Mr M Chabangu (EFF) abstained from adopting the Bill on behalf of the EFF.

The Civil Aviation Amendment Bill was adopted. 

Report of the Portfolio Committee on Transport on the Civil Aviation Amendment Bill [B44 – 2018]

Mr McDonald moved for adoption of the report.

Mr Hunsinger seconded the motion.

The report was adopted. 

The Chairperson thanked the Committee for its hard work and the co-operative spirit in which they had processed the Bill, and the meeting was adjourned.
