Madam Speaker, I just want to put to the House that the matter that is being referred to relates to an utterance made in an SMS that was circulated. The Rules of this House, or any precedent that may have been set as a result of their interpretation and application, was not before that court. Therefore, the legality of constitutionality of the Rule that the Speaker is relying upon, in finding hon Maimane to be unparliamentary, still stands. There is no court judgment of any kind, be it the Constitutional Court or any other court, that has found that Rule to be inconsistent with the Constitution. That Rule must be adhered to. It is a Rule of debate. It is still in force. It is still valid.
The onus is thus on hon Maimane to adhere to the Rules of this House, or not. I humbly submit that it is as simple as that, hon Speaker. [Applause.]
