Dear Portfolio Committee on Human Settlements, Water and Sanitation,

With ref to the meeting of 3 Dec 2019, herewith the following

We are aware that the Chairman of the EAAB, Nkosinati Biko is misleading the Minister of Human Settlement when he responded to the letter Minister wrote to him to enquire about the reported irregularities and contravention of policies by the CEO of the EAAB, Mamodupi Mohlala. The allegations implicate the CEO in financial misconduct and contravention of internal policy and incurring irregular expenditure but the chairman has not taken any action to suspend the CEO and then investigate the reported matters.
Nkosinati Biko has not subjected the reported allegations against the CEO to any form of investigation but only responded with a whitewash covering up response misleading the Minister. The allegations and reported matters were not subjected to proper governance processes at board level. Whistle blowers are also being victimised and require urgent intervention from facing occupational detriment by the CEO.

The CEO has used her own law firm to sue a whistle blower and has subsequently suspended the whistle blower. Other whistle blowers are also subjected to occupational detriment and workplace victimisation. The Chairman is aware of this and is not taking any steps against the CEO.

The chairman approved the CEO international travel without a board resolution and without any approval from the Minister of Human Settlements. The cost ballooned from R79 000 to R320 000 and this was incurred without board approval and without approval from the Minister of Human Settlements.
These matters have been reported and the Chairman is protecting the CEO as he is guilty with her in incurring fruitless and wasteful expenditure with the overspending and incurring irregular expenditure in this regard.
We request that portfolio committee calls the Minister to account on these issues and confirm if the international travel occurred without her approval and what her action in this regard will be as both the chairman and ceo is party to incuring this fruitless and wasteful expenditure and irregular expenditure
We request that portfolio committee calls the Minister to account on the victimisation of whistle blowers at the EAAB by the CEO what her action in this regard will be.
