UNFAIR AND INADEQUATE DECISIONS/FINDINGS OF PUBLIC PROTECTOR

Dear Portfolio Committee on Justice and Correctional Services,

I have been unfairly treated by Adv. Busisiwe Mkhwebane. She issued a report in 2017 on the death of my son who died at school while playing rugby. She exonerated the department of education in the north west of any civil liability or culpability. She blamed the death of my son on himself. Why did he agree to play when he knew he was sick and the doctors had declared him unfit to play any contact sport for a recuperative time not less than 6 months - this following a concussion he sustained while playing.
Less than two weeks later the coach again fielded him and he collapsed and died. The Public protector found no one to blame for this. Further she believes the school owed me no explanation why they took my son, a border and matriculant to go play in JHB on a school day without my permission. When the child was airlifted, comatose to hospital, she agrees with the school there was no need to call me and inform me.

Since the report was released in 2017, the department has not complied with any of her findings and she is just quiet and happy about it. I didnt take this report on review because i had no funds for lawyers. Instead I waited for the department to comply. It has been 3 years since the release of the report and nothing has come of out of this.
The public protector has treated me unfairly ever since she assumed her role as PP. This is not the only report she has clearly defended the department instead of the public. In another Report, she refused to instruct the department of agriculture to recoup state funds from 3 companies which had illegally made about R19 million from a tender which was originally set for R10 million.
