The Secretariat derives its mandate from section 208 of the Constitution, 1996 which states that a civilian secretariat for the police must be established by national legislation to function under the direction of the Cabinet member responsible for policing. Currently, national legislation in the form of section 2(1) (a) of the South African Police Service Act No. 68 of 1995 provides for the establishment and location of the Secretariat under the SAPS. The Committee notes changes to the mandate of the Civilian Secretariat as a result of the Civilian Secretariat Bill [B16-2010].
