Mr Speaker, I move without notice:
That the House -
1) notes that this year marks a centenary for the Natives Land Act, Act No27 of 1913; an Act which, since its commencement on 19 June 1913, "...turned black people into wanderers, labourers and pariahs in their own land";
2) further notes that the President of the Republic announced that government would reopen the lodgement of land claims to accommodate those who missed the opportunity to lodge land claims by 31st December 1998;
3) acknowledges that the programmes of land reform and rural development form part of the top five priorities of government and are interlinked to various programmes of government; and that there is a need for a co-ordinated oversight and public participation process around the reversal of the legacy of the Natives Land Act of 1913; and
4) establishes an Ad Hoc Committee to exercise co-ordinated oversight on the Legacy of the Natives Land Act of 1913, the Ad Hoc Committee to -
a. consist of the 12 members of the Portfolio Committee on Rural Development and Land Reform, and representatives from the following Portfolio Committees: Agriculture, Forestry and Fisheries; Arts and Culture; Public Works; Human Settlements and Co-operative Governance and Traditional Affairs, in accordance with the following proportions: ANC 11, DA 4, COPE 3 , IFP 1 and other parties 1;
b. enquire about the systems put in place for, and to monitor processes toward the re-opening of the lodgement of land claims so that the Commission on Restitution of Land Rights can implement a programme that is fair and transparent to all South Africans;
c. assess the extent to which the programmes of land reform and rural development have addressed the legacy of the Natives Land Act of 1913, especially with regard to the committee mandate in respect of land divisions and agricultural development;
d. assess the success or otherwise of the land restitution programmes;
e. make recommendations on the removal of blockages preventing the restitution of land;
f. exercise those powers in Rule 138 that may assist it in carrying out its task; and
g. report to the House by no later than 20 September 2013.
