(1) With regard to the new visa regulations requiring children under the age of 18 to obtain written consent from both parents before travelling overseas, what should be done in instances where children have lost contact with one of their parents and are unable to obtain their consent; (2) were situations such as this considered when drafting the new regulations; if not, why not; if so, what are the relevant details; (3) considering the time and expense of court procedures, is it expected that in such cases the remaining parent needs to first obtain full custody through a court of law before they are able to unilaterally consent to their child travelling to or from South Africa; if not, what alternative options would the remaining parent have; if so, why?
