    PARLIAMENTARY QUESTION 948 QUESTION: Ms B N Dambuza (ANC) to ask the Minister of Human Settlements: Whether, with regard to an increased need for urban housing against the demographic trend towards urbanization and the growing scarcity in and increased cost of urban housing, his department is promoting the regulation and protection of sectional title holder, if not, why not; if so, what are the relevant details? NW1109E REPLY: The Sectional Titles Act, 1986 (Act No. 95 of 1986) (“the Sectional Titles Act”) which regulate the sectional tittles industry is currently administered by the Department of Rural Development and Land Reform. The Department of Human Settlements is currently in the process of taking over certain provisions from the Sectional Titles Act. However, until this process has been finalized by Parliament, the Department does not have any legislative or Constitutional authority to promote the regulation and protection of sectional title holders since these functions currently still fall within the ambit of the mandate of the Department of Rural Development and Land Reform through the Sectional Tittles Regulatory Board established under the Act.
