Mr P J C Pretorius (DA) to ask the Minister of Higher Education and
Training:
Whether he will consider instituting a full forensic investigation into the
affairs of the Energy Sector Education and Training Authority (ESETA), in
view of the fact that the ESETA has for the 2009-10 financial year again
received a disclaimer from the Auditor-General, who could not do a proper
audit due to the absence of adequate records and documentation; if not, why
not; if so, when will such investigation commence?

REPLY:
⢠Based on the non compliance and under performing of the ESETA, on 17
September 2010, I instructed the Director General to appoint an
Administrator in terms of section 15 of the Skills Development Act to
take over the administration of the SETA. The Director General
appointed Ms Tsakani Matshazi as an Administrator in terms of
Government Gazette No. 33565 dated 17 September 2010 with specific
powers and duties.
⢠The ESETA Administrator was requested to inter alia urgently focus on
the following issues:
⪠Appointment of an acting CEO (To assist with finalization of the
Sector Skills Plan / Strategic plan and Service Level Agreement by
30 Sept 2010)
⪠Appointment of capacity to assist with the financial challenges
in the ESETA as reflected in the Auditor Generalâs report
⢠A Joint Working Group was established to assist the Administrator of
the ESETA in implementing the âPowers and Dutiesâ as published in the
said Government Gazette as well as the âTerms of Referenceâ which
outline the roles and responsibilities of the Administrator in
facilitating the administration of ESETA as required in terms of the
relevant legislation/notice.
⢠The Administratorâs Project Plan for the period of six months, aim
to, inter alia, address the following:
⪠Appointment of an appropriate service provider to address
historical and current year financial reporting, administration and
internal control issues;
⪠Identify an independent service provider to conduct an analysis
of the landscape and produce a business intelligence report, on
both energy and water. Also to advise on the alignment of the ESETA
to the new landscape;
⪠Ensure that a Contract Management service provider is procured in
order to ensure ESETA contracts/programmes are implemented in line
with deliverables, budget and all related administrative
requirements are complied with and;
⪠Engage legal and financial experts to advice on appropriate
measures of ESETA's risk mitigation approach.
⪠Development of the SETAâs Constitution
⢠The above activities have commenced in September 2010 and will be
completed on 31 March 2011.
⢠The Administrator is meeting and reporting on a regular basis, to the
Department in the Joint Working Group in order to monitor progress
against the Project Plan and other processes.
⢠The Administrator will hand over her report to the new board who will
make a decision on whether to undertake a forensic investigation.
⢠My position is that any activity that will lead to holding wrongdoers
accountable and will also lead to the improvement of performance of
the SETAs will be supported.
