Ms D Kohler-Barnard (DA) to ask the Minister of Police:
(1) Whether his National Commissioner signed a performance contract with
him; if not, why not; if so, when;
(2) whether all senior managers in his department signed performance
contracts with the Director-General; if not, (a) which senior managers
did not sign, (b) for what reason and (c) when will it be done; if so,
on which date did each senior manager sign a performance contract?

REPLY:
(1) National Commissioner Bheki Cele was appointed as Director-General of
the South African Police Service on 1 August 2009. A performance
contract has been drafted for National Commissioner Cele in accordance
with the prescripts of the Public Service Commission. The performance
contract has also been aligned to the SAPS Annual Performance Plan for
2009/2010.
The National Commissioner has, since his appointment, visited all
provinces and has had numerous discussions with role players from
various levels in the South African Police Service as well as external
to the Service in order to determine whether the current strategic
direction should be maintained. During his deliberations and visits
additional strategic priorities were identified which are to be
collated and finalised during September 2009. It is expected that
this process will impact on some of the existing plans in the Service.
Once the above process has been completed, the priorities will be
included in the performance contract of the National Commissioner. It
is estimated that signing of the performance contract will occur not
later than 31 October 2009.
The South African Police Service Employment Regulations, 2008, states
that (The National Commissioner, must, as soon as reasonably possible
after his or her date of appointment and the beginning of each
financial year, enter into a performance agreement(. The signing of
the performance contract within 3 months of his appointment we believe
is reasonable.
(2) The National Commissioner of the South African Police Service signs
performance contracts with the Deputy National Commissioners and
Provincial Commissioners within the Service. All of these senior
managers have performance contracts but none of them have signed these
contracts with the new Director-General as yet. This is due to the
identification of additional priorities and expected impact on
existing plans (as previously mentioned).
Once strategic priorities for the Service have been confirmed and the
performance contract of the National Commissioner has been finalised,
the performance contracts of the above mentioned senior managers will
be aligned to his contract. Signing of these performance contracts
should also be finalised by 31 October 2009.
