10. Mr M Swart (DA) to ask the Minister of Social Development:
(1) Since the enforcement of the regulations in terms of the Social
Assistance Act, Act 13 of 2004, (details furnished), in how many
instances has the Director-General of her department taken appropriate
steps to ensure that a child is enrolled and attends school after an
investigation has been completed;
(2) What are the consequences if the Director-General has failed to
ensure that a child is enrolled and attends school after an
investigation is completed?

REPLY:
1) To date no such cases were reported for investigation.
2) The Director-General of the National Department of Social Development
cannot be held to account for ensuring that a child is enrolled or
attends school. The Head of the Provincial Department of Education is
in terms of the section 5 of the South African Schools Act 1996 (Act
No. 84 of 1996) ultimately responsible to ensure that a child, who is
of school going age, is enrolled at and attends school.
