(1) Whether, with reference to her reply to question 570 on 25 August 2009, that allowances is made for brief approaches to confirm cow/calf pairs found in groups or in poor weather conditions, this allowance is written expressly in the permit conditions of the operators; if not, how can this practice be condoned by Marine and Coastal Management (MCM); if so, what are the relevant details; (2) whether operators are expected to submit an incident report to MCM when they approach whales to within 300m to confirm whether they are a cow/calf pair and it turns out that the whales are not a cow/calf pair; if not, why not; if so, what are the relevant details; (3) whether, with reference to the surveys that concluded that the number of whales visiting Walker Bay had increased from 1998 to 2008, thus implying that the boat-based whale watching (BBWW) conditions have had little or no disturbance on the whale population; if not, what is the position in this regard; if so, (a) how many BBWW licences have been granted for areas other than Walker Bay and (b) what are the names of the individuals or entities to whom these licences have been awarded; (4) (a) when does each of the existing BBWW licences expire and (b) what measures will be used to assess the compliance of licence holders before they apply for new licences?
