INTERNAL QUESTION PAPER NO 2 of 2011
Mrs A T Lovemore (DA) to ask the Minister of Home Affairs:
(a) How many court challenges involved her as a respondent (i) in the 2009-
10 financial year and (ii) during the period 1 April 2010 up to the latest
specified date for which information is available, (b) what are the case
references of these challenges, (c) which of these challenges were decided
in favour of the applicants, (d) what costs were incurred in defending each
specified challenge and (e) what costs were awarded against her with regard
to each specified challenge that was decided in favour of the applicant(s)?

REPLY:
(a)(i) The Honourable Member is, respectfully, referred to my response
to Question 2898, in 2010. It is attached, herewith, as Annexure A,
for easy reference.
(a)(ii) A total of 596 cases in the period 1 April 2010, up to, and
including,
31 January 2011. Of these 596 cases, a total of 57 were decided in
favour of the Minister of Home Affairs, 16 were decided in favour of
the Applicants, and 523 are, still, pending before the High Courts of
South Africa.
(b)(i) The Honourable Memberâs attention is, again, respectfully,
referred to my response to Question 2898, in 2010 â as per Annexure A
attached, herewith.
(b)(ii) Attached herewith, as Annexure B, a summary of the 596 cases,
as well as, its respective case numbers.
(c)(i) The Honourable Memberâs attention is, again, respectfully,
referred to my response to Question 2898, in 2010 â as per Annexure A
attached, herewith.
(c)(ii) The following 16 cases were decided in favour of the applicants
with costs incurred:

(d)(ii) The legal cost involved in defending these cases amount to
R5,984,758.84.
(e)(i) The Honourable Memberâs attention is, again, respectfully,
referred to my response to Question 2898, in 2010 â as per Annexure A
attached, herewith.
(e)(ii) Referring to (c)(ii) above, the legal costs amount to
R798,249.70, so far. The Department is, still, awaiting the bills of
cost in respect of 3 cases.
