27. Mr D D Gamede (ANC-KZN) to ask the Minister of Police:
Whether the SA Police Service has the necessary resources to fulfil its
obligations in terms of section 28(4)(a) and other provisions of the Second-
Hand Goods Act, Act 6 of 2009; if not, (i) why not and (ii) what are his
departmentâs plans in this regard; if so, how many persons and/or entities
have been (aa) prosecuted and convicted since the coming into effect of the
Act on 1 May 2012 to date and (bb) prosecuted but found not guilty during
the same period?
(i) The South African Police Service is in the process of building
(ii) The SAPS currently have at least one Designated Second-Hand Goods
Officer at every Police Station in South Africa to deal with Second-Hand
Goods enquiries as well as the processing of Second-Hand Goods
An official training curriculum is in the process of being finalized
and approved and the roll-out of the Designated Second-Hand Goods
Officers Learning Programme is scheduled to start end of June 2014 on
approval of the mentioned training curriculum. Two (2) pilot training
courses were conducted during August and November 2013 to test the above
mentioned training curriculum.
To provide guidance to Designated Second-Hand Goods Officers, the South
African Police Service has compiled a National Instruction for Second-
Hand Goods Dealers/Recyclers, which is in the final phase of
administration before it is approved by the National Commissioner.
Standard Operating Procedures for Second-Hand Goods Dealers/Recyclers as
well as Processes and Procedures were also finalized and are awaiting the
approval of the National Instruction before these policies will be
approved and implemented.
The human resourcing of the second-hand goods environment on
provincial/station level within the South African Police Service is
dependent on the appointment of Designated Second-Hand Goods Officers.
To ensure the physical resourcing of police stations, a ring-fenced
budget have to be obtained as part of the National roll-
out/implementation of the new Second-Hand Goods Act, 2009 (Act No 6 of
2009). No budget has as yet been allocated to Second-Hand Goods for the
implementation of the Act.
