[Mr T M H MOFOKENG: Deputy Chairperson, this Bill amends the Correctional Services Act of 2008; it amends the subsections that deal with the safety of the prisoners. It also amends the Act by inserting new subsections to redefine the Act, to provide for the new medical parole system, and to provide for the management of the safety of remanded detainees.
This Bill responds to the decision that was made at our conference held in Polokwane to concentrate on the rehabilitation of detainees, so that when they are reintegrated back into society, they do not get involved in criminal offences again.
Important changes are the following: the detaining of mentally ill and disabled people. People who are detained in police stations must not be detained for more than seven days. Due to large numbers of sexual harassment incidents in prisons, prisoners have to be guarded carefully so that they are not exposed to harassment.
All the important information or records of the detainees should be kept at the same facilities where they are being remanded. There must be special resources for pregnant women, and their clothes must be different from those of convicted criminals.
With regard to the release of a prisoner, especially if they could infect others, the national commissioner may consult with the Department of Health for revision. A revision of parole for a detainee should be possible after four months of incarceration. A convicted prisoner who is serving a life sentence can be released after 25 years. A prisoner can be released on medical parole if they are terminally ill and will not be able to commit a criminal offence outside.
With regard to a detainee who purposely injured himself, the Correctional Supervision and Parole Board has the right to refuse to release that detainee. If a detainee is terminally ill, the law states that any person can apply for their release on parole on his/her behalf. There must be at least one medical advisory board that has a provincial representative, and regulations must be published six months after the Act has been implemented.
