Deputy Chairperson, the Select Committee on Security and Constitutional Development hereby requests that the Council notes the progress report of 5 November 2010 on the lifting of the provisional suspensions from office of the additional magistrates Mr M K Chauke and Mr J Prinsloo, as tabled by the Minister of Justice and Constitutional Development, in terms of the Magistrates' Act, Act 90 of 1993. The details of such reports were considered by the committee during 2010 and are currently before the Council, detailing the nature of the misconduct, the charges that were laid, and the processes that ensued, as well as the people who dealt with the matters respectively.
The select committee, therefore, accordingly concurs with the recommendations of both reports to lift the provisional suspensions of the above-mentioned additional magistrates of Pretoria and Ermelo, respectively. We therefore, request the Council to accept the report.
