536. Mr D V Bloem (COPE-FS) to ask the Minister of Police:
(1) Whether the (a) SA Police Service and (b) Hawks have been informed of
the policy of rendition between South Africa and Zimbabwe; if not,
what is the position in this regard; if so, what are the relevant
details;
(2) whether, with reference to a media report (details furnished),
certain persons (name furnished) allegedly (a) acted in
contravention of the (i) Immigration Act, Act 13 of 2002, and (ii)
UN Convention governing the treatment of illegal immigrants who are
arrested in the country and (b) have been involved in the (i)
deportation of the persons and (ii) handed them personally to
Zimbabwean police without trial or deportation order (details
furnished); if not, what is the position in this regard; if so, what
are the relevant details?

REPLY:
(1) No policy of ârenditionâ exists between the SAPS and Zimbabwe
Authorities as any such policy would be illegal.
(2) On 5 November 2010, Lt Colonel ML Maluleke, attached to the Tracing
Unit of the Directorate for Priority Crime Investigation was following
up on information received in respect of ATM bombings and bank
robberies. During the course of the investigation, the four persons
alluded to in the Sunday Times report were interviewed, but could not
be linked to investigation. However, during the interviews it
transpired that the persons were illegally in the Republic and as a
result Lt Col Maluleke took the persons to the Department of Home
Affairs, where they were processed and a deportation order was issued.
Major General Sibiya was not involved in the matter.
i) The deportation orders were legally issued by the Department of Home
Affairs after all relevant procedures had been followed.
ii) The persons were handed over to the Zimbabwean immigration officials,
and not the Zimbabwean police authorities, by a South African
immigration official.
iii) Lt Col Maluleke was not aware that any of these persons were sought in
Zimbabwe.
