Mr S H Plaatjie (COPE-NW) to ask the Minister of Health:
(1) Whether he has been informed of the awarding of a tender to a certain
company (name furnished) in KwaZulu-Natal, which planned on importing
unapproved polyurethane female condoms from China; if not, what is the
position in this regard; if so, what are the relevant details;
(2) whether correct tender procedures were followed in this regard; if
not, why not; if so, what are the relevant details;
(3) whether he will make a statement on the matter?

REPLY:
1) I am aware of the awarding of Contract RT75-1-2010 for the supply of
barrier contraceptive, female condom to the company in question. This
was a national tender managed by the Contract Management Division of
National Treasury.
The Court has set aside the State Tender Board's decision to award the
tender to a company that did not meet the required specifications. The
Court has subsequently awarded the tender to the Company that met the
tender specifications.
2) I will be engaging the Minister of Finance (under whose authority the
State Tender Board vests) to get more information on how it occurred
that a company that did not meet tender specifications was awarded the
tender.
3) It is only after I had engaged the Minister of Finance as stated
above, that I can make a statement if necessary.
