Mr Speaker, you received prior notice of this point of order in September. I submit to you that the House cannot proceed with this Bill, because the Bill is in violation of our Rules as they relate to the tagging, for two distinct and separate reasons: Firstly, it was erroneously tagged as a section 75 rather than a combination of sections 75 Billand 76. Secondly, it contains provisions which are beyond the legislative competence of the National Assembly. The Bill, in the sections that I am going to mention to you, Mr Speaker, provides in respect of provincial archives which are a provincial competence; they are an exclusive provincial competence.
Clause 33(4) makes provision for how documents are to be kept in archives. Clause 55(1) gives the power to the Minister to make regulations in respect of provincial archives.
