(1) Whether he will amend the Extension of Security of Tenure Act,
Act 62 of 1997, since the current law does not take into account
the well being of farm workers; if not, why not; if so, what are
the relevant details.
2) how many farm workers were thrown off farms in the (a) 2008-09 and
(b) 2009-10 financial years; if not, why not; if so, what are the
relevant details?
Minister of Labour replied:
1) The Extension of Security of Tenure Act does not form part of the
mandate of the Department of Labour but falls within the ambit of
the Department of Rural Development and Land Reform and thus would
have to be amended by that government Department. However farm
workers are covered by the Basic Conditions of Employment Act and
the sectoral determination for farm workers in terms of their wages
and conditions of employment.
