QUESTION NO 101
DATE REPLY SUBMITTED: 30 MARCH 2010
DATE OF PUBLICATION IN INTERNAL QUESTION PAPER: FRIDAY, 15 MARCH 2010
(INTERNAL QUESTION PAPER: NO 5 â 2010)
Mr D B Feldman (Cope â Gauteng) asked the Minister of Transport:
Whether his department will take legal action against the road works
contractors who did not comply with the standards and norms set by his
department; if not, why not; if so, what legal action?
CW128E
THE REPLY:
The Minister of Transport
These are contractual arrangements between the contractors or
consultants and the respective roads divisions of the Provinces or
Municipalities. In the event of the Department of Transport being
approached by any of the Provincial or Municipal Roads Authorities for
assistance, the Department can assist with "in-house" legal or
technical advice, and therefore allow for due legal process to follow
as per the conditions of a contract.
It should be noted that until now the Department of Transport has not
received any such complaints, and especially not on the National Road
Network.
