416. Mr K A Sinclair (COPE-NC) to ask the Minister of Labour:
Whether the Government will deal with unionism that seems to have an impact
into (a) economic ratings and (b) investor confidence of the country; if
not, why not; if so, what changes will the Government make to reduce the
danger that has been posed by economic instability which is caused by union
activism?
Minister of Labour reply:
Unionism is entrenched in the Constitution of the Republic of South Africa,
likewise the right to freedom of association and trade union rights. These
rights are given effect through the various pieces of labour Legislation in
this country including; the Labour Relations Act, Basic Conditions of
Employment Act Employment Equity Act and others.
Notwithstanding the aforesaid, Government will respond to any undesirable
trade union activity perceived or real, within the framework of the
countryâs legislation.
The Government, through the Deputy President and the Minister of Labour, is
addressing issues relating to labour relations, particularly in the
platinum mining sector.
The Department of Mineral Resources together with the Department of Labour
have also facilitated a Peace & Stability Framework Agreement signed by all
parties in the platinum mining sector which seeks to restore stability in
the sector. There are also plans to engage further with social partners on
labour relations challenges and how to enhance peace and stability in the
industrial relations world of work.
It is not in the spirit and the letter of the labour laws of this country
to allow activities that impact negatively on the economy. For this reason,
government will make every effort that helps the country to achieve greater
stability.
